Changes to current legislation
The Management of Health and Safety at Work Regulations 1999 has re-enacted the Management Regulations 1992. The regulations have changed very little, however certain new obligations have been placed upon employers and greater emphasis made in certain other areas as follows:
  • All employers must now carry out a fire risk assessment (unless otherwise exempt)
  • When a employer introduces preventative or protective measures they now need to conform with the principles set out in Schedule 1 to the Regulations rather than through ACOPS.
  • Employers should now ensure that all necessary arrangements with local emergency services are in place
  • Where required to designate employees to be able to implement fire fighting procedures
  • A new regulation makes it impossible for an employer to claim that he was unable to meet his obligations under the regulations due to any act or default by his employees or other competent persons
  • Also consolidate amendments made to the Management regulations 1992 with regards to young persons and new and expectant mothers
