| Regulation
10 is aimed at implementing EC Directives made under article 100A of the Treaty
of Rome. Although section 6 of the Health and Safety at
Work Act 1974 placed general duties on designers, manufacturers, importers
and suppliers of work equipment, EC Directives are starting to replace this with
more detailed regulations. One of the most significant Directives was the Machinery Directive, which was brought into UK Law by the Supply of Machinery (Safety) Regulations 1992. These Regulations will take precedent over the PUWER Regulations, however this assessment should still continue as it will show compliance with both sets of Regulations. (Regulation 10.2). Regulation 10.1 places a duty on you the user (purchaser) of work to ensure that the equipment should comply with current health and safety legislation before it is used. The supplier or manufacturer etc. has provided all information and instruction on the safe use of the equipment and where necessary the equipment has a CE marking and is accompanied by relevant certification or declarations of conformity.
