| Under these Regulations all employers and the self-employed have a duty to ensure that all lifting equipment provided by them for employees, or in their own use, comply with the requirements of these Regulations. The Regulations also apply to those employers who allow employees to use their own lifting equipment. However the Regulations only apply to equipment used for work activities. For example a lift in a block of flats or a shopping centre is not covered by these Regulations. A lift in an office block, however, which is used by employees working in it the block does fall under these Regulations. The Regulations do not apply to lifting equipment provided for use by members of the general public. But they will have to satisfy the general clauses of the Health and Safety at Work Act 1974. |
